China court to rule on compensation for man jailed for Bo joke

BEIJING (Reuters) - A Chinese court rules on Thursday whether to award damages to a man who spent a year in a labor camp for an online joke about now disgraced leader Bo Xilai, although experts say compensation, if given, is likely to be low to avoid a flood of new grievances.

Fang Hong, a blogger and former forestry official, said he is demanding 367,000 yuan ($59,000) for psychological suffering after being sentenced in 2011 to a year of re-education in a labor camp at the height of Bo's campaign against organized crime in the city of Chongqing, where he was Communist Party boss.

"Although there is no precedent for this in China, if you want to rule the country according to the law ... how else can you provide compensation aside from with money?" Fang said in a telephone interview this week.

His conviction was overturned last year, a few months after Bo was sacked under a cloud of lurid tales of corruption and his wife's murder of a British businessman.

Bo's time in office was marked by popular social projects but also a crackdown on crime overseen by his then police chief Wang Lijun, which won him many fans but also accusations of heavy-handedness and serious miscarriages of justice.

Fang was sentenced for posting a scatological poem mocking Bo and Wang for their abuse of the city's justice system, an egregious example critics say of how Bo stifled dissent.

Fang said he was "not necessarily hopeful" that the court would offer him the full amount, but that he expected some money for damages, based on regulations that allow for meager daily compensation rates for loss of freedom in such cases.

Joshua Rosenzweig, a Hong-Kong-based independent human rights researcher, said the risk of emboldening victims of similar cases made the prospect of a large sum being awarded slim.

"I think it is reasonable to expect that the government might impose some limits on compensation claims to keep a control on the flood gates that might open," Rosenzweig said.

There are no hard and fast figures on the number of cases of legal redress, but more are expected to emerge as Bo's downfall is cemented by his own trial and likely conviction. He was last seen in public last March and is being held in custody.

One prominent lawyer, Chen Youxi, has said over 700 people were convicted as part of Bo's anti-crime gang campaign, including over 70 who were executed.

WAITING

Hu Cheng, a veteran petitioner who blames Wang Lijun for months of illegal detention after his home was seized by a politically connected developer in Chongqing's Beibei district, said people implicated in Bo's campaign are waiting for his conviction.

"Once they are convinced it is safe, they will come back and demand compensation. It will take years to sort out," Hu told Reuters in Beijing.

Bo, 63, was widely seen as pursuing a powerful spot on the ruling Communist Party's elite inner core before his career unraveled after Wang fled to a U.S. consulate for more than 24 hours last February and alleged that Bo's wife, Gu Kailai, had murdered British businessman Neil Heywood.

Gu and Wang have both since been convicted and jailed.

Fang's case, magnified by the high-profile Bo scandal, also has been used by lawyers and activists in a recent surge of calls for reform to China's re-education through labor system.

The system, in place since 1957, empowers police to sentence petty criminals to up to four years' confinement without going through the courts. China's domestic security head Meng Jianzhu said earlier this month reforms were a priority.

As China's new leaders prepare to take up the reins of state power at the annual meeting of parliament in March, they are likely to face an outcry if attempts to address the claims of wrongful convictions in Chongqing are not perceived as swift and just.

"Re-examining and correcting these cases of miscarriages of justice and informing the people in a timely manner is absolutely necessary for restoring judicial authority and public confidence," said Tong Zhiwei, a law professor at the East China University of Political Science and Law in Shanghai.

"If these cases aren't handled well, then the people won't have any confidence in the system," he said.

Gauge of business spending plans edges higher

WASHINGTON (Reuters) - A gauge of business investment plans improved in December, a sign companies were betting the economy will pick up despite fears over tighter fiscal policy.

The Commerce Department said on Monday that non-defense capital goods orders excluding aircraft, a closely watched proxy for investment plans, edged up 0.2 percent last month.

Many economists expected businesses to invest more timidly late last year because of uncertainty over government spending cuts and tax increases, which had been scheduled to kick in this month. Congress ultimately struck a last-minute deal to avoid or postpone most of the austerity measures.

Despite the uncertainty, Monday's data pointed to growing economic momentum as companies sensed improved consumer demand.

"It certainly seems to us that companies are slowly but surely expanding," said Tim Ghriskey, chief investment officer at Solaris Group in Bedford Hills, New York.

In a further sign of business confidence, the November reading on capital spending plans was revised higher to show a 3 percent gain, up from the 2.6 percent rise reported a month ago.

A second report showed a measure of upcoming home resales took a breather in December, declining 4.3 percent. Still, the housing sector posted a rebound last year and economists expect it will add to growth again in 2013.

The business spending data pushed down prices for U.S. government debt, while giving the dollar a lift against the yen. But stock prices opened lower.

New orders for overall durable goods - long lasting factory goods from toasters to automobiles - jumped 4.6 percent in December, beating economists expectations of a 1.8 percent gain.

The gains were broad based, with orders for machinery, cars and primary metals all increasing.

"There's a lot more confidence," said Wayne Kaufman, an analyst at John Thomas Financial in New York.

Orders surged for civilian aircraft and military goods, although those two categories tend to be quite volatile.

Despite the stronger-than-expected demand at the nation's factories, economists think economic growth cooled in the fourth quarter as companies slowed the pace at which they re-stocked their shelves.

Analysts polled by Reuters expect a report on gross domestic product due on Wednesday will show the economy expanded at a mere 1.1 percent annual rate in the fourth quarter, down from a 3.1 percent rate in the previous three months.

However, Monday's report on new orders for long-lasting factory goods suggested businesses are feeling stronger demand from consumers, and are responding by buying more machines to meet that demand. TD Securities economist Millan Mulraine said capital investment likely added to economic growth in the fourth quarter.

Good Reads: Thick financial fog, unskilled workers, self-helped Americans, and a forgiveness that heals

This week's good reads includes a look at the billowing fog surrounding bank regulations, the disappearance of unskilled labor jobs, the American tradition of self-help, and a profound act of forgiveness by a victim's family.

Here?s the short answer to the question posed on the cover of the latest Atlantic Monthly, ?What?s inside America?s banks??: No one knows. Not the regulators, not sophisticated investors, and not even the bankers themselves.

?Banks today are bigger and more opaque than ever, and they continue to behave in many of the same ways they did before the crash,? write Frank Partnoy and Jesse Eisinger, authors of the Atlantic piece.

Complexity and opaqueness are the core of the problem, according to the authors. They cite a wide range of former bankers, investors, and regulatory officials who know the banks best and who ?absolutely? don?t trust their accounting. Even the banks with the best reputations, JP Morgan or Wells Fargo, are impenetrable black boxes with annual reports that defy parsing by even the most expert readers.

The fog of financial complexity is matched by a fog of rules ? as regulators parry moves by the bankers ? but always a few moves behind. The famed Glass-Steagall Act of 1933 ran to 37 pages. Dodd-Frank of 2010 was 848 pages and may balloon to 30,000 in the end. By the time the law?s ?Volcker Rule? is finalized, ?only a handful of partners at the world?s biggest law firms will understand it.?

The authors would offer the following version instead: ?Banks are not permitted to engage in proprietary trading. Period.?

That would save a lot of paper.

Maybe the Luddites had a point

Traditionally, technology has raised incomes for each generation by raising worker productivity. But ever smarter technologies are replacing the need for unskilled labor altogether, argue economists Jeffrey Sachs and Laurence Kotlikoff in a paper for the National Bureau of Economic Research.

Think, for example, of the fully automated turnpike tollbooths or checkout stands at Home Depot. Investors are benefiting from these innovations, as are highly skilled programmers and technologists. (And lines are shorter.) But the jobs that are disappearing are the unskilled ones that offer young people a first few steps up the economic ladder. Without them, the authors argue, we don?t really have a ladder, and lifetime well-being slips by a generation. So what to do? For individuals, this sounds like a warning to get some skills.

?Although smart machines substitute for unskilled workers, they are designed and run by skilled workers. So it?s no surprise that the incomes of skilled workers have risen relative to those of unskilled workers.? The authors note that this is one reason the wage premium for college graduates has increased from around 40 percent in 1999 to more than 80 percent today.

Helping ourselves

From Benjamin Franklin to Oprah Winfrey, from ?How to Win Friends & Influence People? to ?The 4-Hour Workweek,? self-help advice is a very American phenomenon ? and getting more so, according to Laura Vanderkam writing in the quarterly City Journal. More than 45,000 self-help book titles are in print, she writes, and the genre?s share of all titles published doubled from 1975 to 2000.

?There is much to mock? in this field, she notes, and she runs through its history and various critiques. But there is much that is useful as well. Socially mobile Americans construct their own notions of the good life, in DIY-style, ?from what we see of the world around us ? and what we find at the bookstore.?

Crime and recovery

In these weeks following the Newtown, Conn., shooting, there is something ? dare we say healing? ? in The New York Times Magazine story by Paul Tullis about the killing of Ann Grosmaire by her fianc?, Conor McBride, in 2010. The crime came in a moment of overwhelming emotion after an argument between the two community college students that had stretched on for 38 hours. It was not premeditated exactly, but it wasn?t an accident either.

As the father of the mortally wounded and unconscious Ann sat with her in a Tallahassee, Fla., hospital, he ?felt? her say ?Forgive him? so clearly that he spoke his refusal aloud. But he kept hearing that message in her voice. A devout Roman Catholic, he was praying in the hospital four days later, shortly before removing her from life support, when he ?realized it was not just Ann asking me to forgive Conor, it was Jesus Christ.?

The journey the family went on then took them through a process called ?restorative justice,? which strives for agreement among everyone involved in and affected by a crime over how to make restitution. This means that victims, offenders, and their families sooner or later end up sitting around a table and talking.

The upshot, in this story as in others, is forgiveness. Says Ann?s mother, Kate: ?I think that when people can?t forgive, they?re stuck. All they can feel is the emotion surrounding that moment.... Forgiveness to me was self-preservation.?

Ireland won't ease drunken-driving law for farmers

DUBLIN (AP) ? A license to drive drunk? Some small-town politicians think it's just the tonic for rural Ireland.

Councilmen in Kerry, southwest Ireland, passed a motion this week asking the government to create a permit that would allow isolated farmers the ability to drink a few pints and then return home in their car, or on their tractor, without fear of being busted.

Its backers say the measure is needed to combat an epidemic of boredom and depression on farms ever since Ireland imposed tough new blood-alcohol limits on drivers in 2011.

But Justice Minister Alan Shatter shot down the proposal during a speech in parliament Thursday as "grossly irresponsible."

"There is no question of this government, or indeed I don't believe any future government, facilitating individuals drinking in excess of the blood alcohol limits," Shatter told lawmakers.

A generation ago, drunken driving was commonplace in Ireland and even the smallest villages or forlorn crossroads would feature a pub. But in this century the country has steadily improved road safety standards, introducing mandatory driving tests, blood and breath tests and above all a penalty-points system that removes licenses from dangerous drivers, particularly drunks.

The effort has slashed road-related deaths from more than 400 annually in the 1990s to just 162 last year, a modern low in this country of 4.6 million.

Kerry pub owners say their business has plummeted right along with that nationwide carnage ? yet deny any connection between the two trends. They describe the often narrow, lightly trafficked roads near their businesses as safe for people to navigate even after three pints (57 ounces) of beer.

Danny Healy-Rae, who owns a pub and comes from Kerry's most famous and flamboyant political family, says farmers should be allowed to drive tipsy on their tractors because they don't go fast enough to kill anyone. He said those drinking two to three pints at a pub should be issued a permit allowing them to drive home so long as they stay below 30 mph (50 kph).

He was one of five Kerry County Council members who voted for the motion Monday night. Three others voted against, seven abstained and 12 council members didn't show up. Their decision has no legal standing because the national government, not councils, sets policy on road safety.

Healy-Rae ? who like his politician father is nationally famous for wearing a cap everywhere and talking in rapid-fire local dialect easy to parody but hard to understand ? said pub-loving farmers "are living in isolated rural areas where there's no public transport of any kind. They end up at home looking at the four walls, night in and night out, because they don't want to take the risk of losing their license."

He said the older generation provided the sociological fuel to Ireland's tradition of pub-based music and "craic," Irish slang for entertaining conversation.

"All the wisdom and all the wit and all the culture that they had, the music and the singing, that's all being lost to the younger generation," Healy-Rae said. "These older people might as well be living in Japan and Jerusalem, because the younger generation don't see them at all anymore."

Yet even in Kerry, many have dismissed the idea as both dangerous to public safety and impossible to enforce. And alcohol-abuse campaigners say Healy-Rae's logic is twisted, since alcohol is a depressant and hardly a cure for the blues.

"The link between alcohol use and suicide has been well established and drinking alcohol will exacerbate, not alleviate, any mental health difficulties that a person may be struggling with, such as depression or anxiety," said Conor Cullen, spokesman for a pressure group called Alcohol Action Ireland.

The government emphasized that Kerry's council motion was already a dead letter.

"While rural isolation is a real problem," said Transport Minister Leo Varadkar, "the solution to it is not to hand out drink-driving permits."

<strong>"Body of Proof," ABC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> "Body of Proof" has been falling below its timeslot competitor, CBS's "Unforgettable," but it still draws a decent audience and its fans are very vocal. ABC has decided it deserves a third season.

  • "Charlie's Angels"

<strong>"Charlie's Angels," ABC</strong> <br /> <strong>Status:</strong> Canceled<br /> <strong>Why:</strong> Not really a shock for anybody, but "Charlie's Angels" is cooked. Flimsy story, bad remake, questionable casting.

  • "Cougar Town"

<strong>"Cougar Town," ABC</strong><br /> <strong>Status:</strong> Renewed -- for TBS!<br /> <strong>Why:</strong> The Season 3 ratings weren't boosted much by holding this show until midseason, but ABC's wonky air schedule also didn't help ... which is why the news that TBS has picked up the show for a fourth season is huge. • "Dancing With the Stars"

<strong>"Dancing With the Stars," ABC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> "DWTS" may have lost its luster in the ratings, but if the viewers are still coming.

  • "Extreme Makeover: Home Edition"

<strong>"Extreme Makeover: Home Edition," ABC</strong><br /> <strong>Status:</strong> Canceled <br /> <strong>Why:</strong> After a whopping nine seasons, the do-gooding show came to an end in January. But worry not, it will continue to have a few specials to make viewers cry tears of joy.

  • "GCB"

<strong>"GCB," ABC</strong><br /> <strong>Status:</strong> Canceled<br /> <strong>Why:</strong> This "Desperate Housewives"-esque dramedy premiered to less than 8 million viewers, and the phenomenal cast (Kristin Chenoweth, Annie Potts, Leslie Bibb) couldn't bring in a Texas-sized audience, so ABC canceled it.

  • "Grey's Anatomy"

<strong>"Grey's Anatomy," ABC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> Shonda Rhimes' medical drama is a ratings juggernaut, even in its eighth season, and with most of her <a href="http://www.huffingtonpost.com/2012/05/10/greys-anatomy-ellen-pompeo_n_1506113.html?ref=tv" target="_hplink">big stars signed on for more</a>, ABC gave the go-ahead for a ninth season.

  • "Happy Endings"

<strong>"Happy Endings," ABC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> This show is way too "ca-yute" to bubble it, and obviously someone high up at ABC agrees. After its first season was moved around and aired all out of order, the network still gave it another chance to find its audience in Season 2 ... and it has, and hopefully will continue to in Season 3.

  • "Last Man Standing"

<strong>"Last Man Standing," ABC</strong><br /> <strong>Status: </strong> Renewed<br /> <strong>Why:</strong> Ratings for Tim Allen's return to sitcoms have been very strong, making it Tuesday's most-watched comedy. If you can beat "Glee" and "The Biggest Loser," a second season is a given.

  • "Man Up!"

    <strong>"Man Up!," ABC</strong><br /> <strong>Status:</strong> Canceled<br /> <strong>Why:</strong> ABC pulled the show after eight episodes.

  • "The Middle"

<strong>"The Middle," ABC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> Now in its third season, "The Middle" is still holding onto its middle position in the ratings on Wednesday nights, and that seems just about right. It doesn't do "American Idol" or "Survivor" numbers, of course, but with over 7 million viewers, it's a strong comedy for the network that easily beats anything NBC is offering.

  • "Missing"

<strong>"Missing," ABC</strong><br /> <strong>Status:</strong> Canceled<br /> <strong>Why:</strong> Ashley Judd lead this drama about a former CIA agent whose son goes missing, kicking her back into action to find him. The series was only set to air 10 episodes, miniseries-style, with the potential for more, but a cancellation means that's all they're getting.

  • "Modern Family"

<strong>"Modern Family," ABC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> "Modern Family" remains ABC's biggest sitcom success story of the last decade, both in ratings and awards love. This critical darling is getting a fourth season of hijinks with the hilarious Pritchett-Dunphy clan.

  • "Once Upon A Time"

<strong>"Once Upon A Time," ABC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> "Once Upon a Time" has gotten praise for being one of the more family-friendly dramas on TV, and it's been pulling in close to 10 million viewers each week because of it. We're excited by the almost endless possibilities for new fairy tale-inspired stories to tackle in Season 2.

  • "Pan Am"

<strong>"Pan Am," ABC</strong><br /> <strong>Status:</strong> Canceled<br /> <strong>Why:</strong> Poor "Pan Am" just never quite took off. The series' vintage look actually worked against it, much like NBC's swiftly canceled "Playboy Club" -- guess when you're being compared to award-winning shows like "Mad Men," it makes it more than a little tough to live up to the hype.

  • "Private Practice"

<strong>"Private Practice," ABC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> "Private Practice" has never gotten "Grey's Anatomy"-level ratings, and things got shakier when ABC bumped it to Tuesday nights to make room for creator Shonda Rhimes' <em>other</em> new show, "Scandal," but they've given the show a sixth season order.

  • "Revenge"

<strong>"Revenge," ABC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> With a clever mix of drama, mystery and serious revenge-ing, this is hands down one of the most addictive new shows on TV, and we can't wait to see where they take things in Season 2.

  • "The River"

<strong>"The River," ABC</strong><br /> <strong>Status:</strong> Canceled<br /> <strong>Why:</strong> The promise of "Paranormal Activity"-like scares each week quickly fizzled after this show premiered, along with the ratings. The first season's eight episodes came and went, and ABC has nixed any plans for more.

  • "Scandal"

<strong>"Scandal," ABC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> Shonda Rhimes' latest show isn't about doctors at all -- and that's why we're glad it's sticking around. Kerry Washington is amazing as Olivia Pope, a Washington, D.C. fixer with a crack team of specialists helping make bad headlines vanish before they're ever written. Here's hoping for more than seven episodes in its second season.

  • "Shark Tank"

<strong>"Shark Tank," ABC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> Now in its third season, this reality competition show is unlike any other on network TV and ABC is keeping it around for more for that very reason.

  • "Suburgatory"

<strong>"Suburgatory," ABC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> It's smart, quick and not too cute -- "Suburgatory" is consistently named the sitcom you should be watching, but probably aren't. The great cast makes this one a no-brainer, and the ratings have stayed pretty consistent, too. We're thrilled it's getting a second season to shine!

  • "Work It"

    <strong>"Work It," ABC</strong> <br /> <strong>Status:</strong> Canceled <br /> <strong>Why:</strong> Let us count the ways ...

  • "2 Broke Girls"

<strong>"2 Broke Girls," CBS</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why: </strong>At first, people balked at the racist supporting characters, but now it seems that audiences are all over "2 Broke Girls" -- it's ratings have seen a steady increase, and it won the People's Choice Award for Favorite New Comedy.

  • "A Gifted Man"

<strong>"A Gifted Man," CBS</strong><br /> <strong>Status:</strong> Canceled<br /> <strong>Why: </strong>"A Gifted Man's" total viewer numbers were OK for a Friday night, but a 1.3 rating in the 18-49 demographic is especially bad for CBS. Another bad sign: star Patrick Wilson tweeted about the end: "I had a great time. Thanks to my fans. So happy it's done." And done it is.

  • "The Amazing Race"

<strong>"The Amazing Race," CBS</strong><br /> <strong>Status: </strong>Renewed<br /> <strong>Why:</strong> Voted the best reality show on TV several times (albeit years ago), "The Amazing Race" isn't going anywhere. Ratings have dropped a bit, but are still solid.

  • "The Big Bang Theory"

<strong>"The Big Bang Theory," CBS</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> Nothing seems to be able to make a dent in this show. With fantastic ratings (it beat "Idol"!) and a rabid following, we'll be seeing plenty more "Big Bang" before its run is over.

  • "Blue Bloods"

<strong>"Blue Bloods," CBS</strong><br /> <strong>Status:</strong> Renewed <br /> <strong>Why:</strong> The anchor of Friday nights on CBS, "Blue Bloods" has performed well, pulling in around 11 million viewers an episode. The show might not have the youngest audience, but it's still enough for CBS to keep it on the schedule.

  • "Criminal Minds"

<strong>"Criminal Minds," CBS</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> Paget Brewster might be checking out, but "Criminal Minds" is here to stay. In Season 7, the procedural is still a consistently strong ratings performer for CBS.

  • "CSI"

<strong>"CSI," CBS</strong> <br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> Whenever the time comes, the "CSI" mothership will end with a lot of fanfare, but not this year. With new faces Ted Danson and Elisabeth Shue around, there is going to be at least one more season.<br />

  • "CSI: Miami"

<strong>"CSI: Miami," CBS</strong><br /> <strong>Status:</strong> Canceled<br /> <strong>Why:</strong> Out of the three (!) "CSI" programs on the air, "CSI: Miami" is the one to say goodbye first. The one-time ratings giant has been affected by football overruns (just as "The Good Wife" has) and "CSI: NY" has the edge in terms of total viewers, meaning a "Miami" sunset was inevitable. <br />

  • "CSI: NY"

<strong>"CSI: NY," CBS</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> Of the two "CSI" spinoffs, "CSI: NY" is the stronger -- pulling in more than 10 million viewers on a Friday night is no easy task -- and with "CSI: Miami" canceled, "CSI: NY's" renewal was a no-brainer.

  • "The Good Wife"

<strong>"The Good Wife," CBS</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> This critical darling suffered after its move from Tuesdays to Sundays thanks to sports overruns. The viewers are frustrated, but given its strong cast and Emmy love, the show is still coming back for more.

  • "Hawaii Five-0"

    <strong>"Hawaii Five-0," CBS</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> Despite the scheduling setback as Alex O'Loughlin seeks treatment, Season 2 is still doing well for CBS in a very competitive timeslot.<br />

  • "How To Be a Gentleman"

<strong>"How To Be A Gentleman," CBS</strong><br /> <strong>Status:</strong> Canceled<br /> <strong>Why:</strong> Not even having "The Big Bang Theory" as a lead-in could save this David Hornsby project, which only lasted three episodes.

  • "How I Met Your Mother"

<strong>"How I Met Your Mother," CBS</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> CBS renewed "How I Met Your Mother" for two more seasons in March 2011, so fans can look forward to being strung along about the titular mother's identity for a bit longer.<br />

  • "The Mentalist"

<strong>"The Mentalist," CBS</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> Although the show hit a season ratings low in the middle of February, its fanbase and overall ratings were enough to have it return for another season.

  • "Mike & Molly"

<strong>"Mike & Molly," CBS</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> Thanks to an Emmy win and Oscar nomination, Melissa McCarthy is a Hollywood power player and CBS is keen to keep her around. Trader Joe's raises price of 'Two-Buck Chuck'

(AP) ? The popular wine known as "Two-Buck Chuck" will need a new name after the bargain beverage's price was raised.

The Santa Rosa Press Democrat reports (http://bit.ly/V7znEA ) that over the past decade shoppers at Trader Joe's California stores paid $1.99 for a bottle of Charles Shaw shiraz or cabernet sauvignon.

The new $2.49 price tag had shoppers searching for new names. Some customers joked that the brand should now be called "Inflation Chuck" or "Upchuck."

Trader Joe's sold about 5 million cases of the wine last year.

The maker, Bronco Wine Co., said it was able to keep the price so low because it owns 45,000 acres of vineyard, which insulated it from large fluctuations in grape prices.

But bad crops in 2011 and 2012 impacted the price.

Pure colour mixing gets laser power

    Jeff Hecht, consultant

    600px.jpg

(Image: Alexander R. Albrecht, University of New Mexico)

The three coloured jets aren't what they seem. They look like fluids dyed different colours mixing to make a clear liquid. But all the water is clear: the colour comes from red, green and blue lasers. This photo won Alexander Albrecht of the University of New Mexico in Albuquerque first prize in the 2012 After Image photo contest run by Optics & Photonics News.

The colours seem to be flowing through the jets because an effect called total internal reflection is confining the laser beams. Each laser is aimed along the centre of a jet. As the jet bends, the light hits the boundary between water and air at a glancing angle, so it is reflected back into the water and travels further along it. If the light is to travel all the way down the jet, the surface of the jet must be smooth and even to keep the light and the water from breaking up in turbulence. Some light passing through the water jet scatters out of it by bouncing off water molecules, an effect called Rayleigh scattering.

Physicist Daniel Colladon first demonstrated light guiding along a water jet in 1841. Another physicist, John Tyndall, later repeated the demonstration in his popular lectures at the Royal Institution in London. The effect is credited with inspiring concepts from illuminated fountains to fibre optics.

The red, green and blue laser beams mix together to make white light because they are the same intensity and match the human eye's three colour receptors. Combining different blends of these three primary colours can produce the whole range of colour visible to the human eye, including colours such as pink and brown which are not in the rainbow or solar spectrum. Video displays produce images in the same way, by modulating the brightness of tiny red, green and blue emitters across the whole screen.

The Search for Successful Alzheimer's Treatments Moves in New Direction

Alzheimer's disease is the most frequently seen form of dementia that robs those with the illness of not only their short-term memories, but as the disease advances it leads to personality changes and loss of ability to function in activities of daily living. As the sixth-highest cause of death in the United States , Alzheimer's disease has eluded medical science from thus far finding a truly successful treatment for the disease. Researchers in America and worldwide continue to work towards such a treatment and one team in particular is moving in a new direction to do so.

Brain Pacemakers May Hold the Answer

Researchers in the United States have begun clinical research in a non-drug approach to successful treatment of Alzheimer's disease. The research aims to determine whether implantation of an electrical stimulating device -- a brain pacemaker -- may hold the answer to slowing or preventing progression of the terminal illness.

As explained by the Associated Press , the research, still in its early stages, plans to implant the brain pacemakers into a few dozen people diagnosed with early stage Alzheimer's disease at a few hospitals around the nation.

One of the first such devices was implanted in a 57-year-old woman in the early stages of the illness. Researchers at Ohio State University explained to her that the pacemaker in her brain would constantly send electrical impulses to the areas of the brain controlling thinking and memory, in the hope that such stimulation will keep the cells in those areas functioning longer in a healthy manner.

Electrical Stimulation in Use for Movement Disorders

Deep brain stimulation, DBS, the appropriate term for brain pacemakers, is a technique already in use for the treatment of Parkinson's disease and other movement disorders in up to 100,000 people worldwide. DBS is being used successfully for the treatment of chronic back pain , an experimental treatment for the reduction of seizures in epilepsy and a treatment for Tourette syndrome .

DBS isn't without some risks: Holes must be drilled in the skull for the insertion of electrodes into appropriate areas of the brain. Those who will be involved in the early stages of research into the use of DBS to treat Alzheimer's disease will be monitored at regular intervals for two years after implantation of the device.

Deep Brain Stimulation for the Treatment of Alzheimer's Disease

Ohio State University is overseeing the research into the treatment of Alzheimer's disease with electrical stimulation. ClinicalTrials.gov shows that researchers are still recruiting for participants in this study. Eligible participants will be age 45 years through 85 years of age of either sex and with a diagnosis of Alzheimer's disease. More information, including how to contact researchers for possible study participation, can be found at the site.

What to Do If a Neighbor&#39;s Smoking Bothers You - Real Estate Law ...

Apartment buildings have thin walls so if your neighbor is always smoking, you probably know about it. Now you need to know what to do about it.

Of course you might be one of the few people who don't mind second-hand smoke, in which case you don't have to do anything. But for most people, that cigarette smoke seeping through the cracks and invading your personal space can be difficult to bear.

If your building has shared air vents or you and your neighbor keep your windows open, there's no escaping their smoking habit. But you can do some things to make it stop.

As a first step, you may want to look carefully at your lease. Many buildings and apartments are smoke-free because of the difficulty landlords have in getting rid of the smell and damage like stained carpets.

If your lease prohibits smoking, then there's a good chance your neighbor's does too. You could try pointing that out to your neighbor. If that doesn't work, you could go to the landlord and report the violation.

But be careful: You don't want to do that if you're also violating your lease in some way, and it probably won't help you get along with your neighbor. But we're assuming your relationship already isn't that great if your neighbor is stinking up your apartment with cigarette smoke.

For people who own their own property, there may still be a way to stop the smoking.

Planned communities and condominiums often have a list of covenants and restrictions that apply to every unit. More and more of those prohibit smoking.

The list of restrictions is often long, but this is a good time to look through it to see if smoking is prohibited. If it is, you can complain to the board or HOA about the smoking.

As a last resort, you can try to get the courts on your side by suing your neighbor for private nuisance. A private nuisance is something that interferes with or prevents you from enjoying your own property.

While few states officially list second-hand smoke as a private nuisance, many states recognize it as a toxin. As a result, courts are more sympathetic to arguments that second-hand smoke interferes with the enjoyment of life.

Another way to improve your chances in a suit for private nuisance is to hire an experienced attorney. It's always a good idea to involve a professional when your health is on the line.

Top Tips and Tricks You Need to Know for Windows 8

It is a universal constant that in most cases, change takes adjustment. It is virtually impossible for the average person to experience a change in their lives without needing some time to incorporate it into their familiarity and every day routine. How much time usually depends on how big or small the change is, with substantial changes requiring longer periods of time for this adjustment than relatively insignificant changes.

Since the world of technology is one filled with changes, it is not uncommon for this fact to be felt more intensely than other areas that are stable and predictable by comparison. New innovations in both hardware and software bring about new opportunities that while helpful, do require a bit of a learning curve. As such, any opportunity to shorten the length of time to learn these new functions can be extremely helpful.

Windows 8, the newest version of Microsoft?s popular operating system, brings with it a level of change that is a bit higher than what you may have seen in previous new versions. This is mainly due to the fact that one of the main target categories that Microsoft was looking to attract is those that use touchscreen-driven devices. Since most desktops and laptops use a mouse and keyboard for input, many of the new features are not available to people using them.

As a result, we would like to list the top tips and tricks that you can use, which will be sure to cut down on the amount of time needed to make the most of Windows 8. This is, of course, not an all-inclusive list, just one that we felt would provide the most assistance in helping you learn how to use Windows 8 as quickly as possible.

    Hotkeys

Because much of the interface in Windows 8 is geared towards touchscreen users, developing a system using the hotkey functions may be more important than ever before. There is a long list of hotkeys that can be used in conjunction with the Windows key, which can usually be found between the Alt and the Ctrl key on a standard QWERTY keyboard. Among the functions that these shortcuts will provide are the ability to minimize everything shown on the desktop, open up Windows Explorer and enter the tiled Start screen. A complete list of available hotkeys in Windows 8 can be found at http://tech2.in.com/features/software/tips-and-tricks-windows-8-shortcuts-cheatsheet/551452.

    Privacy Settings

Due to the fact that a large portion of Windows 8 is designed to seamlessly integrate the at-home and cloud aspects of your computing activity, more personal data is incorporated throughout the entire operating system then in previous versions. While this may be extremely helpful in many situations, not all users will be comfortable with that much information being kept insecurely. If this is an important consideration for you, the Privacy settings are extremely easy to adjust to a level more in tune with your liking. Simply press the Windows key in conjunction with the letter ?I,? select the Change PC Settings option and then click on Privacy. Here you will find the capability to easily adjust the settings that control who has access to what information on your computer.

    Quick Access

Since the amount of change to the look and feel of the operating system was so dramatic in Windows 8, you may find it a challenge to figure out how to access many of the core components that have become a normal part of your computer experience. This makes the Quick Access menu such an important tool to have. Simply right click on the lower left corner of the screen and you will be presented with a whole list of familiar faces, such as the Control Panel, Task Manager and Device Manager.

    Categorize

The incorporation of apps into the operating system is another nod by Microsoft to those who plan on using Windows 8 in a touchscreen environment. However, even if you are using it on a device without these capabilities, this type of program can prove to be extremely helpful. Unfortunately, they can quickly add up and lead to difficulty in locating the particular app you are hunting for.

This is an easy fix by lumping similar apps and icons together using groups. Drag and drop the apps that you want to group into an unused section of your desktop. Right-click on this gathering of icons and select the Name Group option. Once you have designated its name, you will be rewarded with a much more orderly feel on your desktop.

Using a new and more powerful version of software should not turn into a chore due to the amount of research needed in order to use it. With these simple steps, you are sure to be off and running in no time and enjoying all the benefits that Windows 8 has to offer.

Internet abuzz after first lady seemingly rolls her eyes at Boehner

Monday?s post-inaugural luncheon was a case study in body language and nearly all of the physical evidence centered on House Speaker John Boehner. One interaction in particular has already become an Internet meme today: Michelle Obama rolling her eyes after listening to a comment from the Ohio congressman.

Tumblr blogger ?Mattyrab? was the first to capture the already-classic eye roll in action, sharing video of the exchange with the world in a display described as a ?historical moment in shade throwing.?

The video has already been shared thousands of times across social media sites with viewers speculating on what sparked the First Lady?s facial expression.

We don?t have audio of their exchange, so for now it?s impossible to know exactly what Boehner said to Obama. In fact, it?s entirely possible that her eye roll was simply a reaction to an innocuous joke from Boehner.

But as mentioned at the beginning of this story, the Michelle Obama-John Boehner exchange was only one of several interactions involving the House Speaker. For example, after Boehner?s brief and gracious remarks during the luncheon, he shook hands with President Obama and Vice President Biden. Anyone watching the two exchanges closely would notice a distinct difference. While Boehner and Obama look friendly enough in the actual handshake, at no point do they appear to make eye contact. In contrast, Biden and Boehner appear to share a warmer greeting, smiling at each other and pulling in close for their handshake.

Of course, the analyzing the interaction is inevitably colored by one?s own estimation of these three men, but it certainly appears to correlate with the understanding that Biden has far more amicable relations with Congress than Obama.

Interestingly, House Majority Leader Eric Cantor even appeared to have a warmer exchange with Obama after his remarks, as the two men looked each other in the eyes and traded what appeared to be firm, but friendly, greetings. If that is in fact the case, it?s noteworthy since Cantor is viewed as being even more ideologically opposed to Obama?s political agenda than Boehner.

What do you think? Are political audiences overreacting to Michelle Obama?s facial expression? Or, was it a candid moment captured on film showing that even during the most benign of political events, personality conflicts and personal feelings rise to the surface?

Bow Tie Pasta Primavera. Avocado-Pesto on Top.

Tonight's dinner: Bow Tie Pasta Primavera. Avocado-Pesto on Top. So excited about this colorful, inviting bowl. This recipe gave me a taste of spring or sunny summer in a the middle of winter. (Although, I do have to admit that LA has a bright blue sky today...) Lunch or dinner approved.

The Dish. Tender veggie-colored bow tie pasta is tossed with an array of colorful veggies: red bell pepper, bright green broccoli, zesty red onion, lively black olives, sweet crunchy carrots and optional capers too. This creamy melange of pasta and veggies includes a lemon-tahini-pepper dressing to start, then another rich pesto sauce on top, the side or folded in to create ultra-creamy pasta bliss. Serve this dish warm or chilled. Healthy veggies, comfort food pasta and rich delicious pesto all in one very cheerful bowl. Leftovers are amazing too! Get my recipe..

Pasta + Veggies + Sunny Accents & Flavors. I pulled some bow tie pasta from the pantry and instead of slathering those tender, pointy ties in red marinara sauce I decided to go with rainbow-colored dish. Pasta Primavera. This lively blend of veggies includes a lemon-tahini-pepper sauce for the pasta and veggies. Then over top I dollop on some rich avocado walnut pesto made using spinach and walnuts, garlic and avocado, a splash of EVOO and plenty of lemon too.

Dive into this colorful bowl and brighten up any winter day.

This dish is delish served warm or chilled!

Add the creamy pesto over top of old in to serve..

    Oil Options!
This is a fun recipe to use creative oils in. I recently received an email from a reader asking how in the world one uses healthy hemp oil. Well this pasta is great! Sub a few Tbsp of the hemp oil in place of the olive oil. You could also try pumpkin seed, walnut or grape seed oils. I don't always go overboard on adding oils to my food, but for pasta I really enjoy a nice drizzle in my pasta and veggies. It really gives everything a nice richness and the oil adds fat which adds to the satiety level of my food which helps you feel satisfied without over-loading your plate with pasta. I find that when my pasta contains oil I eat much less of it than when it is more low-fat or oil free.

Kathy's Pasta Primavera with lemon, pepper, tahini and pesto
    vegan, makes 8 cups

    Pasta + Veggies:
2 cups dry bow tie pasta (vegan)
2 cups broccoli florets (cut from one large head of broccoli, thick stem removed)
    1 bell pepper, chopped
    1 red onion, chopped
2 medium carrots, sliced or diced
2 ounces black olives, sliced (or kalamata olives)
    2 Tbsp capers (optional)
    1/4 cup nutritional yeast (optional)

    Lemon Pepper Tahini Dressing:
3 lemons, juices + 1/2 tsp lemon zest (organic)
2 tsp maple or agave syrup (optional, adds hint of sweetness)
    2-3 Tbsp tahini
3 Tbsp extra virgin olive oil (use more or less according to tastes for richness)
    1/4 tsp dried bell pepper
1/4 tsp dried onion or garlic
    1/2 tsp fine black pepper
    1/2 tsp chili pepper
    1/2 tsp salt (to taste)
*all the spices in this dressing are adjustable to taste as well

    Avo-Spinach Walnut Pesto:
    1/2 cup raw walnuts
    1 small avocado
1/3 - 1/2 cup pasta water (or warm water)
1/2 tsp chopped garlic or roasted garlic
1 tbsp extra virgin olive oil
1 cup baby spinach (1 large handful)
    1-2 Tbsp nutritional yeast (optional)
salt to taste OR add 2 tsp white miso paste which is naturally salty

    Directions:

    1. Start out by boiling some salted water on your stove and dropping your bow tie pasta.

    2. While your pasta cooks, you can prep all your veggies and mix up your dressing in a side bowl.

    3. About 2 minutes before your pasta is tender, drop the broccoli into the boiling water. This will blanch the broccoli to a tender state, but not overcook it. This is also easy because you do not have to cook it separately.

    4. Drain your pasta and broccoli and transfer to a large mixing bowl. I like to now add in my nutritional yeast and toss a bit. Also add in your fresh veggies: peppers, onion, carrots. Also fold in the olives and optional capers.

    5. Next you want to gently fold in the tahini dressing. Be careful to toss gently so you do not break apart all the bow-ties. After you have tossed the pasta and veggies and dressing do a taste test and salt to taste. You can also add more seasonings and nutritional yeast if you'd like. Cover bowl and allow the flavors to settle and marinate while you prep the pesto.

    6. Pesto: Add all the ingredients to a high-speed blender or food processor. Blend until smooth. Taste test and salt to taste. (I love using white miso paste to salt my pesto! Basic salt works too.) As you blend - add more or less water to thin out the blend.

    7. You have two options, serve the pasta now slightly warm with the warm pesto OR chill everything. Then you can serve both chilled or serve re-heated pasta with chilled pesto or re-heat both. Both the pasta and pesto taste yummy warm and cold - so you cannot really go wrong here.

    Enjoy!

Pair with white wine and some crusty bread on the side.

Almost seemingly, the easy and convenient way out for that obligatory token gift is a bottle of wine. For most people the school of thought is wine is wine, if the bottle looks good on the outside then you?re covered. Truth be told not all wines are created equal and not all sophisticated looking bottles have the same sophisticated taste on the inside.

There are?eight wines highlighted in this article ranging in price from $20-$75. Within its price range and style of being sourced and made each wine is impressive in its own right with regard to quality and taste. I personally have enjoyed each of these wines and while the best way to fully enjoy a bottle of wine regardless of price is to share it with like-minded people sometimes just splurging on a bottle or treating yourself to a new wine of the week is equally fanciful. The purpose of this article is to eliminate the guessing and agonizing indecision of purchasing a new wine. Each of the wines listed are detailed with background information and tasting notes to assist you in your decision making for that special quaff or obligatory token gift.
